Biocidal Products Regulation – Are You Prepared?

September 1, 2015 is the cut-off date. As of that time, biocidal products can be marketed only if their active ingredients and their manufacturer or importer are included in the Article 95 list. The same applies for biocidal products that are marketed as a precursor chemical for on-site manufacturing of a biocidal agent.

As an involved party, you need to ensure that you:

  • Speak with all responsible persons in the supply chain and clarify who is to be included in the list.
  • Begin planning early on, given that negotiations about common use of data can take time.
  • Submit the documents on time so that ECHA managers can inspect them before the cut-off date of September 1.
  • Plan enough extra time to handle a situation in which the ECHA required additional data.

Use the guidelines prepared by the ECHA, for example.
