EU Commission Will Extend the Duration of the Biocides Review Program

The EU Commission plans to modify the Biocidal Products Regulation (BPR) and extend the duration of the review program for existing active substances. The length of the extension remains unclear: Conversations now speak of three to five years. According to current law, the BPR obligates agencies to complete the review program by December 31, 2024. This deadline was set in 2014.

Existing active substances are substances that were on the market as the active substance of a biocidal product on May 14, 2000 – for purposes other than scientific or product- and process-oriented research and development. Annex II, Part 1 of the review program (Regulation (EU) No. 1062/2014) lists such substances.

Until agencies can evaluate the proposal, transitional measures apply to these existing active substances, which are listed in Chapter 4 of the test regulation governing the review.

We advise you with regard to the requirements of Biocidal Products Regulation, check the labeling and marketability of biocidal products within the EU and carry out the biocide notification in Germany to the BAuA according to the German “Chemikaliengesetz (ChemBiozidMeldeV)”.
