France Preempts EU Regulation and Adopts PFAS Law

On February 20, the French parliament approved a restriction on products containing per- and polyfluoroalkyl substances (PFAS). The text is available in French only. From 2026 onward, the manufacture, import, export, and marketing of PFAS-containing wax products, cosmetics, consumer textiles, shoes, and impregnation agents will be prohibited. The same will apply to textiles in 2030.

Exceptions

Protective clothing for security professionals is exempt from the law. The ban does not cover PFAS-coated pots and pans.

Consequences for monitoring drinking water

The draft law requires drinking water in France to be tested for PFAS in future. The government now wants to introduce regulations as quickly as possible to protect drinking water from PFAS contamination. Recently, PFAS have been increasingly detected in drinking water throughout Europe.

Background

An EU-wide restriction process for PFAS is currently underway that covers more than 10,000 substances. This year, the Committees for Risk Assessment (RAC) and Socio-Economic Analysis (SEAC) will publish their opinions. Further public consultation will follow.
