On the way to the new detergents regulation: status quo and next steps
The Council mandate for the Detergents Regulation was adopted in mid-June 2024. This clears the way for the trilogue negotiations between the European Commission, the Parliament and the Council.
The discussions to date have focused on the following topics:
Phosphorus limit as a bone of contention
While the EU Parliament advocated further restrictions on the phosphorus content in certain detergents, the EU Council would like to maintain the current limits. According to the EU Council's position, the EU Commission would need to carry out further tests before tightening the limits.
Detergents with microorganisms
Requirements are specified for all detergents that contain microorganisms. Special requirements apply to those in spray form. Only manufacturers who can prove that their product is safe should be allowed to sell these products. To this end, however, they must be provided with a required warning and instructions for safe use must be available.
Harmonization with the Cosmetics Ordinance
The Council has updated the list of allergenic fragrances in order to harmonize the Detergents and Cosmetics Regulation. The substances listed therein must be noted on the label.
Harmonization with the Biocidal Products Ordinance
The EU Council is in favor of a review clause that requires the EU Commission to assess the risks to health and the environment posed by the most harmful biocidal products.
Biodegradability
It is planned to extend the biodegradability requirement to all organic ingredients of detergents.
From October 2024, the newly elected parliament will take up its work and press ahead with the adoption of the revised law.
