Brazil REACH: Brazil Publishes Draft Implementing Regulation
On May 13, the Brazilian Ministry of the Environment and Climate Change published a draft implementing regulation for Chemicals Law No. 15.022/2024. The consultation phase is currently underway. The ministry asks that you check the website regularly to learn about the exact deadline for submitting comments.
Basis: Law No. 15.022/2024
The Chemicals Act passed in mid-November 2024 provides the legal framework for chemicals management. The Act requires the establishment of a national chemicals register. Chemical substances manufactured or imported in quantities of one ton or more per year must be registered. Along with other information, the registration must contain data on:
- The manufacturer, importer, or sole representative of the foreign manufacturer
- Identification of the chemical substances
- Production and import, including annual production or import quantities
- The application and use of the substances
In addition to requiring the establishment of a substance registry, the law also defines the framework for risk assessment and control of substances manufactured in Brazil or imported into the country.
Application of Law No. 15.022/2024
The implementing regulation published in May contains details on:
- The registration of chemical substances manufactured in Brazil or imported into the country
- Criteria to be considered in risk assessment of substances
- Assessment of health and environmental risks
- Risk management.
