Senate approves chemicals management law
On October 15, the Brazilian Senate passed a REACH-like framework law for chemicals management (PL 6120/2019) in Portuguese. President Luiz Inácio Lula da Silva must now approve the law.
The next steps
If the law comes as expected, it will be the government's job,
- to draw up a national inventory of chemicals,
- define a procedure for prioritizing substances in the context of risk assessment and
- to name the competent authorities.
Once the online registration system for the national register has been set up, companies must register all substances that they manufacture and/or import in quantities of one ton or more per year within three years.
Viewpoint registration
Companies should have the following information ready for registration:
- Details of the manufacturer and/or importer
- the quantities produced or imported annually;
- the chemical name including CAS or IUPAC number
- the hazard classification according to the valid GHS standard (currently GHS Rev.7 applies)
- Recommended uses.
Which substances are excluded
According to the draft, the law will not apply to substances for which there is separate legislation, such as food additives, pesticides, active pharmaceutical ingredients and medical devices. Mixtures, articles and monomer units of polymers and "harmless polymers", for which a separate regulation is planned, are also not subject to registration.
