Brazilian REACH:
Senate Approves Chemicals Management Law
On October 15, the Brazilian Senate passed a REACH-like framework law for chemicals management (PL 6120/2019). President Luiz Inácio Lula da Silva must now approve the law.
Next steps
If the law is approved as expected, it will be the government's responsibility to:
- Create a national inventory of chemicals,
- Establish a procedure for prioritizing substances as part of the risk assessment,
- Appoint the relevant authorities.
Once the online registration system for the national inventory is in place, companies will have three years to register all substances that they manufacture and/or import annually in quantities of one ton or greater.
Viewpoint registration
To register, companies must provide a wide range of information, including:
- Details of the manufacturer and/or importer
- The quantities produced or imported annually;
- The chemical name, including the CAS or IUPAC number
- The hazard classification according to the applicable GHS standard (currently GHS Rev.7)
- Recommended uses.
Excluded Substances
According to the draft, the law will not apply to substances subject to their own legislation, such as food additives, pesticides, active pharmaceutical ingredients, and medical devices. Furthermore, mixtures, articles, monomer units of polymers, and “harmless polymers,” for which a separate regulation is planned, are not subject to registration.
