New CLP Hazard Classes Are Now in Force – What EU Manufacturers Must Now Consider

New obligations of EU Regulation 2023/707 have been in force since May 1. Now companies must classify substances they wish to place on the market in accordance with the updated CLP Regulation.

Background

Delegated Regulation (EU) 2023/707 introduced new hazard classes into the CLP Regulation for

  • endocrine disruptors (ED HH and ED ENV),
  • Persistent, bioaccumulative and toxic products (PBT and vPvB)
  • as well as for persistent, mobile and toxic products (PMT and vPvM).

Simultaneously, transition periods were defined for implementation of the new requirements. One deadline applies immediately. Now EU manufacturers must ensure that they consider the new hazard classes when classifying all substances they intend to place on the market from May 2025 onward.  

Applicable deadlines

  • For new mixtures: The hazard classes apply as of May 1, 2026
  • For substances on the market before May 1, 2025: The hazard classes apply as of November 1, 2026
  • For mixtures on the market before May 1, 2026: The hazard classes apply as of May 2028

Reclassification: now what?

If substances and mixtures already on the market require reclassification, safety data sheets (SDS), labeling, and, in the case of online sales, the hazard statements on the Internet must be updated.
