New EU Regulation "ESPR" Replaces Ecodesign Directive of 2005: What to Do Now

Regulation (EU) 2024/1781 went into force on July 18, 2024, replacing the Ecodesign Directive that was amended in 2009.

The previous Ecodesign Regulation was limited to the energy efficiency of products. The new regulation focuses on all relevant environmental considerations and extends the scope of the regulation to almost all products, including chemicals and cleaning products. The requirements cover the entire life cycle of a product, including the extent to which it can be reused. Articles 27 to 38 define the obligations of economic operators and should be of particular interest to manufacturers.

What happens next

The coming months will be tense while waiting for the EU Commission to define the specific requirements as part of delegated acts

By March 2025, the EU Commission is to draw up a work plan for all product groups that require development of product-specific regulations in the coming years. The preferred product groups include iron, steel and aluminum, cleaning agents, and chemicals. On its web site, the German Federal Environment Agency writes that the first specific product regulations implementing the Ecodesign Regulation will come into force by the end of 2025.
