PIC Regulation:
EU Updates List of Hazardous Chemicals

In January 2025, the EU Commission added five industrial chemicals and 35 pesticides to Annex I of the Prior Informed Consent (PIC) Regulation. The updated regulation (EU Regulation 2024/3199) applies as of March 2025. The PIC Regulation covers the import and export of certain hazardous chemicals. New obligations now apply to the companies concerned.

The substances listed in Appendix I are banned or severely restricted in the EU. The newly added substances include the following industrial chemicals, all of which are classified as toxic to reproduction in category 1B:

  • 1,2-Benzenedicarboxylic acid, dihexyl ester, branched and linear;
  • Dihexyl phthalate
  • 1,2-Benzenedicarboxylic acid, di-C6-10-alkyl ester or mixed decyl, hexyl and octyl diesters
  • Sodium perborate, perboric acid, sodium salt and
  • Sodium peroxometaborate

Substances subject to notification

Companies that want to export these substances from or import them into the EU must meet these and other requirements: 

  • In accordance with Article 8 (2), companies must report every first export of a substance in a calendar year.
  • This notification must be made at least 35 days before export.
  • For substances listed in Parts 2 and 3 of Annex I, the exporter must obtain explicit consent from the country of destination prior to export.

Who is responsible

The responsible authority in Germany is the Federal Office for Chemicals (BfC) of the Federal Institute for Occupational Safety and Health (BAuA). The ECHA operates a database (ePIC) used to process the entire procedure electronically. The ECHA has just updated this IT tool.

Alarming development

In 2023, 65 times more EU-wide banned substances were exported compared to 2022. That’s the finding of the authors of the current PIC report, published in December 2024. This trend has alarmed the EU, which is considering a ban on the production and export of hazardous chemicals.
