REACH Fees: EU Commission Publishes Implementing Regulation (EU) 2025/2067 – Substance Registrations Will Become More Expensive

On October 15, 2025, the EU Commission adopted Implementing Regulation (EU) 2025/2067. It has been in force since November 5, meaning that all companies now face a price increase of 19.5% for substance registrations. Fee reductions are still planned for small and medium-sized enterprises (SMEs).

The EU cites the average annual cumulative inflation rate of 19.5% published by Eurostat for 2021, 2022, and 2023 as the reason for the increase in fees.

SME Verification Procedure

In addition to the fee increase, the EU has also redefined the procedure for verifying company size (SME status). If companies wish to submit REACH registrations or authorization applications, they must apply to ECHA for recognition of their SME status at least two months in advance. Once the ECHA has approved the application, the company will be entitled to a discount of up to 95%. This regulation will apply from February 5, 2027.

Temporal Limit on SME Status

If the company does not meet the SME criteria, the ECHA charges a fee for verification of the company’s size. The status remains valid for three years after the ECHA recognizes it. However, two months before the end of the three-year period, the company must reapply for its status if it wishes to receive a fee reduction.

Struggle Over Lead Time

In the first draft of the law, the EU had demanded a lead time of six months instead of the two months that are now in effect. Numerous companies opposed this period, prompting the EU Commission to reduce the long lead time in an updated draft.
