REACH Revision in the Final Stretch: EU Commission and Member States Discuss Last Details

At the beginning of April this year, during the meeting of the Competent Authorities for REACH and CLP (CARACAL), the European Commission informed member states of the current state of the discussions. At the urging of industry representatives, the drafts of the regulations have recently been reviewed and adapted again to reduce the administrative burden and maintain the competitiveness of the chemical industry.

Key information about registration

Here are some highlights of the European Commission’s presentation:

  • The ECHA is to be granted the right to revoke already-issued registration numbers if companies fail to meet requirements.
  • Future registrations will be valid for a period of only ten years.
  • Annexes III (criteria for substances registered in the tonnage band 1-10 tons) and XIII (standard information requirements for chemicals manufactured or imported in the tonnage band >10 tons) are to be deleted. In response, dossiers are to be updated immediately if a substance is identified as being of very high concern.
  • The Community Rolling Action Plan (CoRAP) is to be replaced by a register that authorities can access.

Key information on authorization and restriction

  • Inclusion of a substance in the candidate list paves the way for a requirement for authorization; its use can also be restricted.
  • In the future, authorization of substances manufactured in large quantities for a few users should take precedence over the processing of applications for authorization for substances manufactured in smaller tonnage bands and used in a wider variety of applications.
  • Authorizations are to be limited for each individual applicant.
  • If an application for authorization is rejected, the company should be granted a transitional period until use of the substance of very high concern is completely prohibited.

  • April 25: End of the EU Member States’ consultation on the presented content
  • January–July: Commission impact assessment
  • October–November: Adoption of the legislative package by the Commission and submission of the proposal
  • November–December: Final eight-week consultation
