Revision of the Cosmetics Regulation: What the EU Commission is planning
The EU Commission has published the road map for updating the Cosmetics Regulation. The assessment process began on February 21. As part of the process, the EU wants to collect as much information as possible to help it decide whether a revision of the Regulation is even necessary. A revised draft of the legislation is then expected in the second quarter of 2026.
More than ten years of experience
According to the road map, all stakeholders will be invited to evaluate the Cosmetics Regulation and submit their comments by March 21. Experience with the Regulation has been extensive, given that it came into force in 2013. By 2024, the annexes had been amended 50 times and corrected 11 times. Article 2 was amended once. The EU would like to use feedback from stakeholders to determine if the objectives of the regulation have been achieved and if it continues to serve its purpose, particularly in view of the chemicals strategy for sustainability and digital transformation.
What’s coming
A public consultation is planned for the second quarter of 2025. The EU hopes that the contributions from manufacturers, suppliers, retailers, regulators, and consumer organizations provides new insights for the planned revision.
In the crosshairs: hazardous contents
The updated law must, above all, set guidelines for dealing with potentially hazardous contents – primarily endocrine disruptors, allergens, and nanomaterials. The EU will therefore have to consider the need for further safety measures.
Other important questions
As part of the revision, the EU will also consider how the Cosmetics Regulation might be aligned with other chemicals legislation, such as the CLP, REACH, and the Detergents and Biocidal Products Regulations. How can consumers be better protected? The overriding question is the actual value of an EU-wide regulation. Can the objectives of the regulation be achieved just as easily at a national level?
