New Detergents Regulation: What Will Change for Businesses Starting in 2029

Regulation (EU) 2026/405 on detergents and surfactants comprehensively modernizes the European legal framework for laundry and cleaning products after more than two decades. In addition to established requirements for product and environmental safety, the regulation places greater emphasis on digital product information, new product and distribution concepts, and clearly defined responsibilities throughout the supply chain. Furthermore, the definition of detergents is expanded and adapted to current market developments. The key provisions take effect on September 23, 2029, and replace the previous Regulation (EC) No. 648/2004.

Clear Responsibilities Across the Supply Chain

The new Regulation further clarifies the obligations of economic operators and distinguishes between manufacturers, authorized representatives, importers, and distributors. Manufacturers must assess the compliance of their products with the requirements of the Regulation and document this assessment in the technical documentation. In addition, the requirements for providing ingredient information and submitting relevant product data have been revised.

The role of the Authorized Representative is newly introduced. While manufacturers established outside the EU are required to appoint an authorized representative, manufacturers established within the EU may delegate certain tasks to an authorized representative through a written mandate. The responsibilities of importers and distributors are likewise addressed separately and independently.

Digital Product Passport and Updated Labeling Requirements

One of the key innovations is the introduction of the Digital Product Passport (DPP). A DPP will be required for every detergent as well as every surfactant intended for end users. Access will be provided through a data carrier linked to the product or its packaging.

At the same time, the general labeling requirements are being updated. In addition to traditional physical labeling, certain mandatory information may in the future be provided digitally. However, key information will still be required to remain on the physical label. The Digital Product Passport and digital labeling therefore constitute two separate elements of future product information provision.

New Product Formats and Distribution Models

The Regulation also addresses product and distribution concepts that were not, or only partially, covered under the previous legal framework. This includes, in particular, detergents containing intentionally added microorganisms, for which specific requirements are established regarding safety, stability, and labeling, among other aspects. Another new feature is the introduction of explicit rules for refill sales of detergents. Additional requirements also apply to distance selling with respect to the provision of mandatory product information.

Environmental Requirements Expanded Gradually

The existing biodegradability requirements for surfactants remain largely unchanged. At the same time, the scope of these requirements will gradually be extended to additional components of detergents. As of March 23, 2032, biodegradability requirements will also apply to films and polymers used in films. From March 23, 2034, certain additional intentionally added organic substances will be brought within scope.

Preparing Early for the New Requirements

Regulation (EU) 2026/405 further develops the existing regulatory framework, particularly with regard to responsibilities, labeling requirements, digital product information, and new product and distribution concepts. Companies should use the transition period to review their product portfolios and adapt product data, documentation, and relevant processes to the new requirements at an early stage.
