The German Prohibited Chemicals Regulation places requirements on the placing on the market of certain hazardous substances. This applies to some substances mentioned by name as well as to substances and mixtures with the following labels under the CLP Regulation:

  • Hazard pictogram GHS06 (skull and crossbones)
  • Hazard pictogram GHS08 (health hazard) and the signal word and one of the hazard statements H340, H350, H350i, H360, H360F, H360D, H360FD, H360Fd, H360Df, H370 or H372
  • Hazard pictogram GHS03 (flame over a circle)
  • Hazard pictogram GHS02 (flame) and H224, H241, H242

Among other things, you must notify the competent authority that you are supplying such products to professional users or resellers. In addition, the persons in the company involved in the supply of the products must be instructed once a year in accordance with Article 8 of the German Prohibited Chemicals Regulation (ChemVerbotsV). The company also needs a qualified person who has the necessary expertise in accordance with Article 11. If you supply the products concerned only to industrial and commercial customers (not to private individuals), you can commission an external expert.
