UK REACH: Deadline for Downstream User Import Notification (DUIN) Passes – More Than 4,000 Chemicals Transferred to UK Registrations

Numerous manufacturers, distributors, and/or downstream users headquartered in Great Britain have taken advantage of the opportunity to submit notifications for their chemicals with a DUIN by October 27. They are now considered importers and have also gained time to register their chemicals.

Depending on the tonnage band, the following registration periods apply:

  • For chemicals > 1000 t/a and for chemicals classified as especially hazardous: October 28, 2021 to October 28, 2023
  • For chemicals > 100 t/a: October 28, 2021 to October 28, 2025
  • For all other chemicals > 1 t/a: October 28, 2021 to October 28, 2027

However, it remains doubtful that all the companies that have submitted notifications for their chemicals will later follow up the notifications with registrations. Industry representatives like Jonathan Swindell of the European Automobile Manufacturers’ Association (Association des Constructeurs Européens d’Automobiles: ACEA) believes that many companies are using the notification as a tactical maneuver. He thinks that they will use the time up to the end of the registration period to become a British distributor or to look for an only representative for their imports.

Along with a notification performed with a DUIN, many companies have also directly transferred their EU registrations into UK registrations. More than 4,000 chemicals – of a total of 22,500 chemicals registered in the context of REACH – have been transferred according to this grandfathering process according to information from the British Health and Safety Executive (HSE).
